Rental Agreement

This Vacation Rental Agreement (this Agreement), is entered into by the Guest specified above (you), in favor of Utah Vacation Homes, LLC. a Utah limited liability company (UVH or we), as agent for the owner of the Property (as defined below).

Reservation/Term. You hereby reserve the Property, subject to the terms and conditions of this Agreement. This Property has been reserved by you from 4:00 p.m. on (the Arrival Date) until 10:00 a.m. on (the departure date).

Deposit. Your reservation is secured by a deposit (Initial Payment) made by you, which is 30% of your rental amount. 

If the terms of this Agreement are met, UVH will apply the Initial Payment to your Rental Fee (as defined below). UVH will retain any interest earned on the Initial Payment.

Guest Policies. By executing below, you acknowledge that you have received the Guest Policies of UVH attached hereto as Attachment A, and that you have read and understand such policies. By executing below, you agree that you and your Permitted Invitees (defined below) will be bound by all terms and conditions of the Guest Policies.

Prohibitions on Use. The Property is to be used by you, and any and all invitees, relatives, friends, or individuals who access, use, occupy or enter the Property (your Permitted Invitees) for general vacation purposes only. By executing below, you agree that you and your Permitted Invitees will not use the Property for hosting weddings, parties, large gatherings, commercial business, filming or other similar activties. In addition, this Property is a non-smoking unit and no pets are allowed. Smoking inside the Property, housing any pet, hosting large gatherings, parties or weddings, or any other damage caused by you or your Permitted Invitees to the Property will result in a damage fee, which will be debited from your credit card. You hereby authorize UVH to maintain an open account on your credit card in an amount equal to the Initial Payment for the purposes of seeking compensation for any damage to the Property or others caused by you or your Permitted Invitees. However, the recovery by UVH of any damage caused by you or your Permitted Invitees shall not be limited to the amount of the Initial Payment.

Damage. You are responsible for any damage or loss occurring in between and including your Arrival Date and your Departure Date (the "Rental Period"). The Accidental Damage Waiver is non-refundable and covers accidental damage to the Property occurring at any time during the Rental Period. If you do not purchase the Accidental Damage Insurance, a $1500 Damage Deposit will be charged to your credit card at time of booking. At the end of the Rental Period, we will inspect the Property and your Damage Deposit will be refunded to your credit card less any cost(s) associated with repairs due to any damage occurring during the Rental Period. Charges for damage are not limited to $1500 and your credit card will be charged for any and all expenses associated with any and all repairs or the replacement of damaged, missing or broken items. The Accidental Damage Insurance does not apply to nor does it cover damage related to any acts of vandalism, damage caused by intentional or reckless conduct, damage caused by misuse or abuse of the Property or damage related to or caused by any use of the Property or activity on the Property that is prohibited by the terms of this Agreement or by any law, ordinance or rule.
Vacation Rental Damage Protection:  This Vacation Rental Damage plan covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out.  The policy will pay a maximum benefit of $1,500.00.  Any damages that exceed $1,500.00 will be charged to the credit card on file.  If you damage the real or personal property assigned to your rental accommodation during the trip, the Insurer will reimburse the lesser of the cost of repairs or the replacement of the property, up to $1,500.00.  Certain terms and conditions apply.  Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy (www.vacationrentalinsurance.com/G20VRD). The Vacation Rental Damage can be purchased up to , and including at, check-in.  By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Utah Vacation Homes any amount payable under the terms and conditions of the Vacation Rental Damage.  Please contact Utah Vacation Homes directly if you do not wish to participate in this plan or assignment.

Fees. Your fees for using the Property include a rental fee for the Property and charges described on the first page of this agreement (collectively, the Rental Fee). Unless the remainder of the Rental Fee is paid by check, we will debit the above credit card for the balance of the Rental Fee by ninety (90) days before your Arrival Date.  Your Initial Payment will be forfeited if the balance of the Rental Fee is not received by such date.

Minimum Stay. UVH requires a minimum stay of seven (7) nights during Holiday Season, five (5) to ten (10) nights during Sundance (varies by property), five (5) nights during Presidents, and Regular Seasons, and three (3) nights during all other time periods. Minimum stay requirements are not limited to these dates.

Cancellations. UVH retains the right to cancel this Agreement until the Rental Fee is received from you.
Large Properties accommodating 14 or more require 2 night non-refundable initial payment. If a reservation is cancelled by you 45 days or less before arrival, 100% of the Rental Fee will be forfeited unless the unit can be rented to another party. This reservation will be held so long as the Initial Payment and signed Agreement are received by UVH within two days of today. 

All Other Properties If a reservation is cancelled by you 90 days or more prior to the arrival date, then a $150 processing fee will be assessed and the balance returned to you. If a reservation is cancelled by you more than 45 days but less than 90 days before arrival, then you will forfeit your entire Initial Payment. If a reservation is cancelled by you 45 days or less before arrival, 100% of the Rental Fee will be forfeited unless the unit can be rented to another party. This reservation will be held so long as the Initial Payment and signed Agreement are received by UVH within two days.

Unavailable Property. UVH retains the right to refund the Total Payment or provide accommodations of equal or greater value, at no extra charge, if it becomes necessary to relocate you due to the unavailability of a property. Specific unit numbers and bed configurations are not guaranteed.

Limitations of Liability. The Property is under the management of UVH who acts only as a rental agent for the owner of the Property, and UVH has entered into an agreement with the owner of the Property whereby the owner has agreed to indemnify UVH for, among other things, the condition of the Property. By executing below, you agree that in no event will UVH or any of its representatives be liable (for any actions or omissions of UVH) to you, your Permitted Invitees, or any other person for any claims, proceedings, liabilities, obligations, damages, losses, costs or similar items, whether in contract, tort or under other fault or wrongdoing, in an amount exceeding the Rental Fee. By executing below you hereby agree that you and your Permitted Invitees will not pursue any legal action against UVH or against UVH for any loss, accident, expense, damage, claim, warranty, injury or similar loss caused or incurred as a result of your use of the Property or arising out of any condition on the Property. You further agree to indemnify and hold UVH harmless from any claim or demand, made by any third party due to or arising out of your or your Permitted Invitees use of the Property or any violation of this Agreement by you or your Permitted Invitees. In addition, UVH will not be responsible for loss of money, jewelry or valuables of any kind on the Property.

Disclaimer of Warranties. You and your Permitted Invitees expressly acknowledge and agree that your use of the Property is at your own risk, and that you assume all risk with respect thereto. UVH expressly disclaims all warranties of any kind and nature, whether express or implied, relating to the Property. UVH makes no warranty that the Property will meet your expectations or that the information about the Property is error free, or accurate.

Collection of Funds. If any party to this Agreement resorts to any legal action against the other, the prevailing party shall be entitled to recover reasonable attorneys fees in addition to any other relief to which the prevailing party may be entitled. This provision applies to the Agreement and the Guest Policies.

Applicable Law/Venue. This Agreement shall be governed by and construed in accordance with the laws of the State of Utah, without regard to the principles of conflicts of laws. By executing this Agreement, you and your Permitted Invitees agree to submit to the exclusive jurisdiction of and agree to the venue of the courts of the State of Utah, whether state courts or federal courts or federal courts located in the State of Utah. You and your Permitted Invitees hereto agree not to bring an action in any court of law located outside the State of Utah.

Entire Agreement. This agreement, together with the Guest Policies, comprises the entire agreement between you and UVH and supersedes all prior written or oral agreements regarding the subject matter herein. No modification shall be binding upon you or UVH unless made in writing and signed by you and an authorized representative of UVH.
By signing below you acknowledge that you have read and agree to be bound by this Agreement, and the Guest Policies attached hereto.

Guest Policies

Capitalized terms not otherwise defined herein shall take the meaning ascribed thereto in the Rental Agreement.

Check-In Directions
Express Check-In. UVH provides and Express Check-in service for the Property. This service allows you to go directly to the Property without having to stop at an office to check-in and pick-up your keys. When the final rental balance is charged (45 days prior to your arrival date), you will receive an email with driving directions to the Property from Salt Lake International Airport. A four-digit code will be included with the directions. This code provides access to the Property through either an electronic keypad on the front door or garage, or by providing access to a key located in a lockbox.
Upon arrival at the Property, you will find a Utah Vacation Homes Information Sheet (the Information Sheet) either on the refrigerator or in the clear plastic magazine rack. The Information Sheet will contain unique instructions and guidelines for the Property. If you have any additional questions or need further assistance, please call UVH during normal business hours at 1-800-667-9456 .

Check-Out Directions
Prior to departure please return all furniture to its original location and place garbage in the garbage cans. If time permits start the dishwasher with all used dishes.

Early Arrival/Late Departure Policies
Check-in time is 4:00 p.m. The Property is not available for check-in prior to 4:00 p.m. However, UVH may try to accommodate your needs if the Property is available. Accommodating your needs does not guarantee the Property will be cleaned and available prior to 4:00 p.m. Please contact UVH 7-10 days prior to your arrival date to determine if special arrangements can be made. If you arrive early without prior, written approval from UVH, UVH may (at its sole discretion) charge you for one additional night at the stated rate for the Property.
Check-out time is 10:00 a.m. Quality control and cleaning crews may arrive any time after 10:00 and must have full access to the Property. UVH will try to accommodate your needs if the Property is available. This may include allowing you to store your luggage (at your own risk) in the Property’s garage after 10:00 a.m. If you delay the quality control or cleaning crews by not departing prior to 10:00 a.m., UVH may (at its sole discretion) charge you for one additional night at the stated rate for the Property.

After Hours/Emergency Services
UVH does not provide a 24 Hour front desk. However, an attendant is on call 24 hours a day for emergency services. If you have an emergency, please call 1-80... . When prompted, select the after hours/emergency menu and leave a detailed message. Your message will be immediately paged to our on-call attendant. This attendant will listen to your message and return your call shortly thereafter.
For other non-emergency services, please call 1-800-667-9456 . When prompted, select the menu for guest services and leave a detailed message. A UVH representative will respond to your message during regular business hours.

Lockbox Key
If available, the electronic keypad should be used for general access to the Property; otherwise physical keys may be used. Although physical keys may not be provided for general access to the Property, the Property does have a backup physical key for emergency use. The backup key must remain in the lockbox at all times and if you access the backup key, please return this key to the lockbox immediately. If the backup key is lost during your stay, you will be assessed a $100 replacement charge.

Internet Access
Internet access may or may not be provided in the Property. If the Property does have Internet access, UVH makes no warranty that such access will be functional.

Housekeeping
Daily/Midweek housekeeping is not provided. However, you may obtain housekeeping services for the Property for an additional fee. If you are interested in such services, please contact UVH prior to your arrival during regular business hours at 1-800-667-9456 .

Provided Supplies
UVH will provide a limited amount of supplies for the Property. These supplies include a basic amount of soap, shampoo, laundry detergent, bathroom tissue, dishes, utensils, pots and pans, linens, and 2 bath towels per person in accordance with the advertised occupancy. Extra supplies are your responsibility.

Suggested Supplies
You should consider bringing the following extra supplies: cooking spices and condiments, additional shampoo, conditioner, and other hair products, toilet paper, tissue paper, laundry detergent, and any specialty pans (such as a wok) you may need to cook specific meals.

Fireplaces
The Property may or may not contain a fireplace. If the Property does contain a fireplace, please review the Information Sheet for instructions on fireplace usage and safety prior to using such fireplace. UVH assumes no responsibility for any damage or injury cause by you (or your Permitted Invitees) use of a fireplace and you expressly waive any rights, claims, or causes of action you or your Permitted Invitees may have against UVH for injuries or damage resulting from such use.
If the Property contains a fireplace, it may be either wood burning or gas. If the Property contains a gas fireplace, please refrain from burning materials of any kind therein.

Garbage Removal
The Information Sheet for the Property contains instructions for garbage removal. In general, you shall place all garbage cans on the street for pickup on the scheduled date.

Personal Items
UVH is not responsible for personal items that are lost or stolen during your stay. In addition, UVH assumes no responsibility for personal items that are left behind after your stay.

Parking
Due to snow removal and/or HOA parking regulations, parking is limited to designated parking garages and driveways only. No street parking is allowed.

Noise Ordinances
You and your Permitted Invitees must comply with city regulated noise ordinances and any additional noise regulations as provided in the Information Sheet. In particular, please be aware hot tub use is generally prohibited after 10:00 p.m.

Occupancy
Advertised maximum occupancy limits will be enforced. UVH may assess (at its sole discretion) a surcharge of $50 per night for each guest staying at the Property beyond the advertised maximum occupancy or require you to vacate the property

Damage
You are responsible for reporting any damage (especially water damage) to the Property immediately upon discovering such damage. If such damage occurred prior to your arrival, you must immediately disclose such damage to avoid liability.
You will be assessed a minimum of $200 if the property smells of smoke or if cigarette butts/ashes are found on the premises upon your departure.
